Trump is appealing a decision by Judge Tanya Chutkan, who rejected his request to dismiss the case. Trump’s argument is that former presidents can’t face criminal charges for things they did while in office.
The Special Counsel wants the Supreme Court to deal with this matter fast, even before a lower appeals court makes a decision. The Special Counsel, Jack Smith, says this case involves a fundamental question about our democracy.
Trump’s appeal has put his trial on hold, which was supposed to start on March 4, 2024. Smith says it’s crucial to resolve Trump’s immunity claims quickly and proceed with the trial if the claim is rejected.
Smith believes Trump’s claims are wrong, and only the Supreme Court can definitively settle them. Some legal experts think Trump’s lawyers might use the immunity appeals to delay the trial, giving him more time to campaign against President Joe Biden.
