Disney+ Terms Block Lawsuit Over Allergy Death, Disney Says
Disney World argues that a man cannot sue them for his wife’s death because of the terms he agreed to when signing up for a free Disney+ trial. Jeffrey Piccolo is suing Disney after his wife died in 2023 from a severe allergic reaction at a Disney World restaurant.
Disney claims that the terms of use, which Mr. Piccolo agreed to in 2019, require disputes to be settled through arbitration, not in court. They argue this agreement also applied when he bought park tickets in 2023.
Mr. Piccolo’s lawyers call this argument absurd, saying it’s unreasonable to apply Disney+ terms to a serious wrongful death case. They also point out that his wife never agreed to these terms.
Legal experts say Disney’s argument is unusual and could be challenged in court. The case will be reviewed by a Florida judge in October to decide if it will go to arbitration, which is usually faster and more private than a court trial. The BBC reports.
